US TSCA Compliance Requirements

TSCA is the US federal law governing chemical substances. Its Section 6(h) rules restrict five persistent, bioaccumulative and toxic (PBT) chemicals, with one deadline landing about a month after this page was last reviewed.

TSCA (15 U.S.C. § 2601 et seq.) is administered by EPA’s Office of Pollution Prevention and Toxics.

Section 6(h) PBT rules, finalized January 2021 and amended November 2024, restrict five chemicals: decabromodiphenyl ether (decaBDE), phenol isopropylated phosphate (3:1) (PIP (3:1)), 2,4,6-tris(tert-butyl)phenol (2,4,6-TTBP), hexachlorobutadiene (HCBD) and pentachlorothiophenol (PCTP), codified at 40 CFR part 751, subpart E.

PIP (3:1) has the most detailed, staggered prohibition schedule of the five, running from 2021 through 2039.

TSCA Section 8(a)(7)'s separate PFAS reporting rule is covered on the multi-state PFAS reporting page, since it maps to PFASTracker rather than MatCheck.

Who must comply

  • Persons who manufacture (including import), process, or distribute in commerce the five PBT chemicals must comply with the restrictions in 40 CFR part 751, subpart E.
  • 40 CFR § 751.407, specific to PIP (3:1), reaches "all persons" — not only manufacturers — for its processing, distribution and article-import prohibitions.

Deadlines

  • 2021-03-08 — General prohibition on processing/distribution of PIP (3:1) and PIP (3:1)-containing products or articles takes effect (with a 0.1% de minimis carve-out for non-intentionally-added PIP (3:1)). (eCFR — 40 CFR § 751.407(a), as of 2026-09-27)
  • 2022-01-01 — Prohibition on PIP (3:1) in photographic printing articles takes effect. (eCFR — 40 CFR § 751.407(a), as of 2026-09-27)
  • 2024-10-31 — All persons are prohibited from processing/distributing PIP (3:1) for use in articles, and from processing PIP (3:1)-containing articles. (eCFR — 40 CFR § 751.407(a), as of 2026-09-27)
  • 2025-01-06 — Prohibition on PIP (3:1) in adhesives and sealants takes effect (per the November 19, 2024 amendment to the rule). (Federal Register — document 2024-25758, as of 2026-09-27)
  • 2026-10-31 — All persons are prohibited from distribution in commerce of PIP (3:1)-containing articles — the next upcoming PIP (3:1) deadline as of this review. (eCFR — 40 CFR § 751.407(a)(2), as of 2026-09-27)
  • 2039-11-21 — Prohibition on PIP (3:1) in lubricants/greases and in parts for new motor vehicles (including heavy machinery) takes effect. (eCFR — 40 CFR § 751.407(a)(2), as of 2026-09-27)
